Cadet's Code - UNIFORM CODE OF CADET JUSTICE (UCCJ)
PURPOSE: the purpose of this policy is to provide the New York Military Youth Cadets, with proper guidelines for
disciplinary action. Application of these guidelines must
be consistent and equitable, so that all members receive like
treatment for similar offenses
And to protect a cadets rights when an offense has
been committed;
SECTION 1 GENERAL
Open communications between the executive staff, general
staff, all members and the establishment of a friendly, cooperative
training and recreational atmosphere go a long way toward
eliminating serious disciplinary problems. Officers and NCOs
should make every effort to ensure that members have a thorough
understanding of Corps policies and an awareness of what is
expected in the area of duty
Performance and personal conduct. Officers and NCOs are urged
to coach and counsel all New York Military Youth Cadets
members in an effort to prevent the need for discipline. However,
for those times when discipline is necessary, the procedures
described below should assist Officers and NCOs in determining
proper course of action.
They are guidelines, not a substitute for common sense.
SECTION 2 ORDER OF DISCIPLINE
The New York Military Youth Cadets, is committed to
a policy of honor, integrity and progressive discipline. Therefore,
in most situations, Cadets will be discipline in accordance
with the following:
- WARNINGS
- Verbal Warning- The purpose of this step is to forewarn
the cadets member. There may be reasons to believe that
the member honestly did not know his/her behavior was
an infraction or that his/her performance was unsatisfactory.
This approach, though informal, must be documented.
However, let the Cadet member know that it was an informal
discussion.
- Writing Warning - The writing warning should be very
specifically describe the following:
- The infraction.
- Potential consequences if the situation does not
improve.

Corrective action.
Copies of all writing warnings must be given to the
accused Cadet member and the Administration Officer.
Blank forms may be obtained from the Administrative
Officer.
- SUSPENSIONS
A Cadet member may be suspended from duty. Such suspensions,
as well as length of suspension, are based on the nature
of the infraction and the cadets past record. Repeat
infractions will result in a more severe disciplinary action
than the prior.
- DISCHARGES
Immediate termination may occur, when appropriate, based
on all circumstances, including the nature of the offence
and the cadets past record. Only the New York Military Youth Cadets, Military Executive Board may terminate
a cadet member. NCO;s and platoon commanders may recommend
termination of a cadet member. Such recommendations will
be in writing form and accompanied by other evidence and/or
testimony in support thereof.
SECTION 3 VIOLATIONS
3.1 Absent without leave - A.W.O.L.
3.2 Improper, incomplete, or no uniform
3.3 Improper, or no identification card
3.4 Assault
3.5 Theft of any corps, member or other institutions
property
3.6 Improper unit record keeping
3.7 Failure to call in / notifying chain of command
3.8 Personal hygiene and/or grooming below standards
3.9 Misdemeanor / felony violations while on or off duty
3.10 Conducting unauthorized training
3.11 Endangering the welfare of cadets
3.12 Engaging in horseplay, running, scuffling or causing
a disturbance
3.13 Lateness - unexcused or excessive
3.14 Absence - unexcused or excessive
3.15 Smoking in unauthorized areas
3.16 Contributing to unsanitary conditions or poor housekeeping
3.17 Failure to follow a superiors instructions, verbal
or in writing
3.18 Leaving an assigned duty post without proper relief
or authorization
3.19 Loitering on Corps property during training hours
3.20 Violations of Dress code policy
3.21 Causing loss of material or equipment due to careless,
negligence, of deliberate Acts
3.22 Soliciting or distributing literature without prior
authorization.
3.23 Violating a safety rule or practice.
3.24 Making false, vicious or malicious statements about
any member of the Corps, or guest
3.25 Fraudulent claim of sick leave
3.26 Refusing to do assigned work
3.27 Disrespectful, insulting or abusive acts or language
toward any superior Copsauthority, co-member or guest.
3.28 Unauthorized statements to other cadets organizations,
or authority (OPSEC -violations).
3.29 Engaging in discriminating or sexually harassing conduct.
3.30 Negligent and inconsiderate treatment of another member.
3.31 Discussing confidential information concerning a member
with unauthorized personnel.
3.32 Insubordination.
3.33 Intentional misstatement of concealment of facts in
connection with enrollmentor any investigation, inquiry
or other proceedings. Falsifying Corps records
3.34 Illegal possession of a firearms, or explosive on Corps
property
3.35 Removal of Corps property without authorization.
3.36 Soliciting funds or services from members of any other
person while on training duty.
3.37 Violations of the New York Military Youth Cadets
Drug and Alcohol Abuse Policy.
3.38 Interfering with the work performance of another member,
or threatening , Intimidating or coercing another member.
3.39 Fighting on Corps property while on training duty.
3.40 Willfully or carelessly damaging, defacing or mishandling
of Corps or supporters equipment, property or the
property of a member, guest or other.
3.41 Sleeping while on duty.
3.42 Willful or careless violations of safety, fire prevention,
and security regulations.
3.43 Any other conduct detrimental to the NYNMYCs
operations.
3.44 Miscellaneous Violations
3.45 Doing or performing other activities without the Commanders
permission.
Since the NYNMYCs, cannot anticipate all of the circumstances
which may warrant a warning, Suspension or discharge, the
proceeding list of disciplinary offences is not all-inclusive.
If a situation arises which is not covered by this illustrative
regulations of disciplinary offences, the NYNMYCs will
evaluate the situation and issue appropriate discipline, including
discharge.
SECTION 4 REVIEW BOARD
The Cadet Review Board (CRB ). Will be comprised of no less
than (2) Executive Military Board Members, one (1) senior
staff officer and one (1) senior NCO or above.
